Dave Mertens addresses Committee of the Flemish Parliament on reform of the Commercial Lease Act

As reported last month, the Flemish Parliament is preparing a reform of the Commercial Lease Act. In response to two draft memoranda dated 8 March 2016 (N-VA) and 13 April 2016 (CD&V), a series of three hearings were held before the competent Committee for Economy, Work, Social Economy, Innovation and Science Policy. First the various stakeholders were given an opportunity to speak: on 20 September 2016 Comeos, CIB, BVA and RFB were heard, followed on 6 October 2016 by Voka, Unizo, Verenigde Eigenaars and BLSC.

Then, on 20 October 2016, a number of academics and practical experts appeared in order to give their views on the reform. Atty Dave Mertens addressed the Committee members on the necessity of a reform and on the advantages and disadvantages of proposed changes contained in the draft memoranda and such as they had been discussed at the two previous hearings. The lively debate can be seen again on the website of the Flemish Parliament.

The hearings have thus been concluded, and the majority will now jointly work out a single draft decree, after which there will be further consultation with the stakeholders and experts. We will of course keep you informed about further developments.
